This usually happens when a tenant wants to leave before the lease ends.<\/p>\n<p>The original tenant (head-tenant) remains legally responsible for the tenancy.<\/p>\n<p>The sub-tenant has no relationship with the landlord but enters into a separate agreement with the head-tenant, who becomes the landlord of the sub-tenancy.<\/p>\n<p>Having a flatmate or housemate living at the property with you is not seen as subletting. This is because a flatmate shares the property and facilities with the tenant.<\/p>\n<h3><\/h3>\n<h3>Getting permission to sublet<\/h3>\n<p>You must have the landlord&#8217;s permission to sublet the property to someone else. The original tenant no longer has any rights or responsibilities in relation to the tenancy.<\/p>\n<h3>Getting consent for an assignment<\/h3>\n<p>The landlord&#8217;s agreement is required for assignment. If refused, the tenant can serve a <a href=\"https:\/\/rtb.ie\/ga\/renting\/ending-a-tenancy\/notice-of-termination-guide\/\" target=\"_blank\" rel=\"noopener\">Notice of Termination<\/a>.<\/p>\n<h3>Assignment conditions<\/h3>\n<p>If a Part 4 tenancy is assigned to someone other than a sub-tenant, the new assignee must live in the property for 6 months before gaining <a href=\"https:\/\/rtb.ie\/ga\/renting\/types-of-tenancies\/private-residential-tenancies\/\">Part 4 tenancy rights<\/a>.
