The date of service of the rent review notice is the date the rent review takes place.<\/li>\n<\/ul>\n<p>If a tenancy ends, the landlord can set a new rent for a new tenancy. They do not have to wait 24 months from the date of the last rent review for the previous tenancy.<\/p>\n<p>A rent review can happen more often if:<\/p>\n<ul>\n<li>There has been a &#8216;substantial change in the nature of the accommodation&#8217;; and<\/li>\n<li>The substantial change results in the market rent for the property being greater than when the rent was last set.<\/li>\n<\/ul>\n<h3>What counts as a &#8216;substantial change&#8217;?<\/h3>\n<p>A property qualifies as having a &#8216;substantial change&#8217; if it meets one of these criteria:<\/p>\n<ul>\n<li>A permanent extension increasing the floor area by at least 25%.<\/li>\n<li>Work improving the Building Energy Rating (BER) by at least 7 ratings.<\/li>\n<li>Work resulting in any 3 or more of the following:\n<ul>\n<li>A permanent change to the internal layout.<\/li>\n<li>Adaptation for use by a person with a disability.<\/li>\n<li>A permanent increase in the number of rooms.<\/li>\n<li>An improvement of at least 3 BER ratings (if previously D1 or lower).<\/li>\n<li>An improvement of at least 2 BER ratings (if previously C3 or lower).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\t\t\t\t\t\t\t<\/article>\n\t\t\t\t\t<\/div>\n\t<\/div>\n<\/section>\n\n\n<section id=\"market\" class=\"header-paragraph-block rtb-block  margin-top-xs margin-bottom-xs\">\n\t<div class=\"container\">\n\t\t<div class=\"content\">\n\t\t\t<article class=\"cms-content\">\n\t\t\t\t\t\t\t\t\t<h2>Calculating market rent<\/h2>\n<p>Rent outside of RPZs cannot be more than market rent. This applies when setting rent at the start of a tenancy or when reviewing rent. It applies to <a href=\"https:\/\/rtb.ie\/ga\/renting\/types-of-tenancies\/private-residential-tenancies\/\">private tenancies<\/a> and student specific accommodation. Different rules apply for <a href=\"https:\/\/rtb.ie\/ga\/renting\/setting-reviewing-rent\/setting-and-reviewing-approved-housing-body-ahb-rent\/\">setting rent for AHBs<\/a> and for <a href=\"https:\/\/rtb.ie\/ga\/renting\/types-of-tenancies\/cost-rental-housing\/\">cost rental tenancies.<\/a><\/p>\n<h3>What market rent means<\/h3>\n<p>&#8216;Market rent&#8217; is the rent a willing tenant (not already living there) would pay, and a willing landlord would accept for the property, considering:<\/p>\n<ul>\n<li>The terms of the tenancy.<\/li>\n<li>The rental values of properties of a similar size, type and character and in the same or a comparable area.<\/li>\n<\/ul>\n<p>For rent reviews, you must provide examples of rent for 3 comparable properties in the Notice of Rent Review (see below).<\/p>\n\t\t\t\t\t\t\t<\/article>\n\t\t\t\t\t<\/div>\n\t<\/div>\n<\/section>\n\n\n<section id=\"notice\" class=\"header-paragraph-block rtb-block  margin-top-xs margin-bottom-xs\">\n\t<div class=\"container\">\n\t\t<div class=\"content\">\n\t\t\t<article class=\"cms-content\">\n\t\t\t\t\t\t\t\t\t<h2>Completing a Notice of Rent Review<\/h2>\n<p>You must serve a valid Notice of Rent Review on the tenant.<\/p>\n<ul>\n<li>The form must follow the prescribed format exactly.<\/li>\n<li>Any changes to wording, layout or missing information may invalidate the notice.<\/li>\n<li>The notice must state the new rent amount and how it was calculated.<\/li>\n<\/ul>\n<p>You can download the <a href=\"https:\/\/rtb.ie\/ga\/wp-content\/uploads\/2025\/05\/Notice_of_Rent_Review_Form.pdf\">Notice of Rent Review form (pdf)<\/a><\/p>\n<h3>Comparable properties<\/h3>\n<p>You must include 3 comparable properties in the Notice of Rent Review. Comparable properties must:<\/p>\n<ul>\n<li>Have been advertised within the last 4 weeks before the notice was served.<\/li>\n<li>Be of a similar size, type and character. For example, a one-bedroom apartment cannot be compared to a 3-bedroom house.<\/li>\n<li>Be in a comparable location. This means town to town, suburban to suburban or rural to rural.<\/li>\n<\/ul>\n<p>If there are no comparable properties in the immediate area, you can use properties from a similar area. For example, a 3-bed property in one rural town can be compared with a 3-bed property in another rural town.<\/p>\n\t\t\t\t\t\t\t<\/article>\n\t\t\t\t\t<\/div>\n\t<\/div>\n<\/section>\n\n\n<section id=\"giving\" class=\"header-paragraph-block rtb-block  margin-top-xs margin-bottom-xs\">\n\t<div class=\"container\">\n\t\t<div class=\"content\">\n\t\t\t<article class=\"cms-content\">\n\t\t\t\t\t\t\t\t\t<h2>Giving the tenant notice of new rent<\/h2>\n<p>You must give the tenant a minimum of 90 days&#8217; notice before the new rent takes effect.<\/p>\n<p>The Notice of Rent Review must be served at least 90 days in advance.
