Under this system:<\/p>\n<ul>\n<li>Rent can only be increased once per year by 2% or the rate of inflation, whichever is lower. The rate of inflation is measured by the Consumer Price Index (CPI).<\/li>\n<li><strong>For private tenancies created from 1 March 2026:<\/strong> Re-setting to market rent is allowed in specific cases. In these cases, rent can be increased by the rate of inflation (CPI), even if this is higher than 2%. Read about <a href=\"#June\">how a property can qualify for this exception<\/a>.<\/li>\n<li><b>Re-setting to market rent for SSA: <\/b>There are different rules on when SSA can re-set to market rent. Read the<a href=\"https:\/\/www.rtb.ie\/setting-and-reviewing-ssa-rents\/\"> rules on setting and reviewing rent in SSA<\/a><\/li>\n<li><b>Approved Housing Body and cost rental tenancies: <\/b>There are different rules for setting rent for <a href=\"https:\/\/rtb.ie\/renting\/types-of-tenancies\/approved-housing-bodies\/\">Approved Housing Body<\/a> and\u00a0<a href=\"https:\/\/rtb.ie\/renting\/types-of-tenancies\/cost-rental-housing\/\">cost rental <\/a>\u00a0tenancies. National rent control rules do not apply to these tenancies.<\/li>\n<\/ul>\n\t\t\t\t\t\t\t<\/article>\n\t\t\t\t\t<\/div>\n\t<\/div>\n<\/section>\n\n\n<section id=\"setting\" class=\"header-paragraph-block rtb-block  margin-top-xs margin-bottom-xs\">\n\t<div class=\"container\">\n\t\t<div class=\"content\">\n\t\t\t<article class=\"cms-content\">\n\t\t\t\t\t\t\t\t\t<h2>Setting rent for a new private tenancy<\/h2>\n<h3>Step 1: Check rent control rules<\/h3>\n<p>When setting rent for a new tenancy \u2013 first check if rent increase restrictions apply or if setting to market rent is allowed for this tenancy.<\/p>\n\t\t\t\t\t\t\t<\/article>\n\t\t\t\t\t<\/div>\n\t<\/div>\n<\/section>\n\n\n<section id=\"block-block_00a0c0f798964ce9dd0a57bc05054f29\" class=\"table-block rtb-block margin-top-xs margin-bottom-xs\">\n\t<div class=\"container\">\n\t\t<div class=\"content\">\n\t\t\t\t\t\t<table>\n\t\t\t\t\n\t\t\t\t\n\t\t\t\t<tbody>\n\t\t\t\t\t\t\t\t\t\t\t<tr>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<td><b>When is setting to market rent not allowed?<\/b><\/td>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<td>Landlords starting a new tenancy from 1 March 2026 cannot set the rent at market rent if there was a tenancy in the property within the last 2 years&nbsp;<b>and<\/b> that tenancy ended because the landlord:\n<ul>\n<li>&#8211; Intended to sell<\/li>\n<li>&#8211; Needed the property for themselves or a family member<\/li>\n \t<li>&#8211; Planned to change the use of the property<\/li>\n<\/ul>\n\n<br>\nThese are sometimes called \u2018no fault terminations.\u2019  Re-setting to market rent is not allowed when the last tenancy ended due to no fault of the tenant. \n<br><br>\nThere are different rules on when re-setting to market rent is allowed in Student Specific Accommodation. Read about <a href=\"https:\/\/www.rtb.ie\/setting-and-reviewing-ssa-rents\/\"> setting and reviewing SSA rents.<\/a><\/td>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/tr>\n\t\t\t\t\t\t\t\t\t\t\t<tr>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<td><b>When is setting to market rent allowed?<\/b><\/td>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<td>Landlords starting a new tenancy from 1 March 2026 can set the rent at market rent if:\n<ul>\n \t<li>&#8211; The last tenant ended the tenancy by choice.<\/li>\n \t<li>&#8211; The last tenancy ended because the tenant breached their obligations. For example, if they did not pay rent.<\/li>\n \t<li>&#8211; The last tenancy ended because the home no longer met the tenant\u2019s needs.<\/li>\n \t<li>&#8211; It is a first-time tenancy in the property.<\/li>\n \t<li>&#8211; There was no tenancy in the property for at least 2 years (or 1 year if a protected structure).<\/li>\n \t<li>&#8211; The property is a protected structure and there was no tenancy in the property for at least 1 year.<\/li>\n<li>&#8211; The last tenancy ended for substantial renovation and the landlord has offered it back to the previous tenant. (The property must have undergone &#8216;substantial change&#8217;)<\/li>\n<\/ul>\n<br>\nThere are different rules on when re-setting to market rent is allowed in Student Specific Accommodation. This means you can only increase\nrent by 2% or the rate of inflation each year, whichever is lower. You must submit a copy of the notice to the RTB within one month of the tenancy start date. <br><br>\nYou must include a statement with your rent setting notice that the rent is not above market rent. If you do not serve it to the RTB, the rent review notice is invalid.<\/span><\/span><span class=\"EOP Selected SCXW164040558 BCX8\" data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:278}\">\u00a0<\/span><\/li>\n<li>You must serve a statement with your rent review notice that includes:\n<ul>\n<li>The last rent amount.<\/li>\n<li>The date the last rent was set.<\/li>\n<li>A printout from the RTB Rent Calculator showing how you calculated the new rent.<\/li>\n<li>Details of 3 comparable properties from the RTB Rent Register.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h4><b>Exception:<\/b><\/h4>\n<p>In areas that became a Rent Pressure Zone (RPZ) in the last 2 years, the rent cannot be reviewed until 24 months after the date the rent was last set or reviewed for the tenancy.
