What to do about an unregistered tenancy  

All tenancies that fall within the jurisdiction of the Residential Tenancies Act 2004 (as amended) should be registered with the RTB. Guidance on how to register your tenancy can be found here.  

If the tenancy has not been registered within one month of the beginning of the tenancy a late fee will apply. Information on the fees that apply to a tenancy registration which is received late by the RTB is available here.  

What do I do if I have received a notice?  

Contact the RTB quoting the reference number on the received notice/solicitor's letter, the reference will begin with ‘RE’ and can be found at the top of the notice.  

To discuss the required actions that may be taken or if there is a query regarding non-compliance/ legal proceedings, contact the RTB by email at enforcement@rtb.ie on or leave a voicemail by calling 0818-303038 and a staff member will be in contact.   

If a tenancy is unregistered, an application to register a tenancy must be submitted on receipt of a Registration Enforcement notice. When a registration number is received, confirming the registration of the tenancy in question, the RTB should be contacted with this number to confirm registration and to stop legal proceedings.

Report an unregistered tenancy  

If you would like to report a potential unregistered tenancy to the RTB, please email enforcement@rtb.ie with a completed Registration Enforcement Referral Form. Alternatively, you can leave a voicemail on 0818-303038 and a staff member will be in contact.  

What are the penalties for not registering a tenancy? 

A person who does not comply with their responsibility to register their tenancy/ tenancies faces a criminal conviction and a fine of up to €4000 and/ or 6 months imprisonment, if convicted. In addition to the Court imposed fines, the landlord will also have to pay the RTB’s legal costs which can be in the region of €2,500 plus VAT per case. 

The RTB   will work with landlords to assist them in registering their tenancies if they contact us on receipt of the formal notification and in advance of any summons issuing. However, if a summons has issued then the case will go to Court.
