How does RTB criminal prosecution work

What breaches can lead to criminal prosecution?

We can prosecute a landlord if they:  

1. Do not register a tenancy 
2. Do not update tenancy details 
3. Do not give rent setting information at start of tenancy 
4. Set rent above the legal limit 
5. Do not notify the RTB of a rent exemption 
6. Do not provide a rent review notice correctly

How can we identify a breach?

We can identify a possible breach of rental law from: 

• Information from other public bodies and Government departments 
• A report from a tenant or member of the public 
• RTB internal data 

We treat all possible breaches of rental law seriously. 

Stages of criminal prosecution process 

Stage 1: First notice

This is a letter or email that tells you we believe there is a breach of rental law. You now have 28 days to: 

• Correct the breach and notify us. 
• Contact us and provide proof if you believe you have not broken rental law.

Stage 2: Second notice

This is a letter that gives you a final 14 days to correct the breach. If you do not correct the breach and respond within the 14 days, you are guilty of an offence and can face criminal prosecution. 

Stage 3:  Court summons

The RTB’s solicitor will issue a court summons to you. 

Stage 4:  Court appearance

A judge will consider evidence from the RTB that you have broken rental law. They will also consider your response and evidence. If you are found guilty, this can result in: 

• A criminal conviction 
• A class A fine of up to €5,000 
• Imprisonment for up to 12 months 
• Additional penalties of €250 for each day the breach continues 
• Payment of the RTB’s legal costs.

Stage 5: Publication

We publish details of court enforcement outcomes on the RTB website.
